1. rental confirmation
The rental confirmation is only binding when the payment has been received on the account of the lessor. The rental confirmation includes the rented object with inventory and accessories.
2. payment and conclusion of contract
With the completed binding booking form, the lessee offers the lessor the legally binding conclusion of the rental contract. The landlord will then send the tenant a written booking confirmation - usually by email. The total rent is to be paid within the period specified by the landlord. After payment of the rent the tenants send proofs of personal identification (copy of identity card) to the landlord, since a physical admission of the data does not take place at the holiday resort. The rental contract is considered concluded and therefore legally binding upon receipt of payment and proof of identification.
3. equipment
The equipment was carefully and thoughtfully carried out according to the wishes and ideas of our guests. The guests are therefore requested to treat the apartment with care in order to ensure a pleasant and restful stay for the following guests as well. We therefore ask you to leave the apartment in a tidy condition (dishes cleanly stored and garbage can emptied).
Damages, both to the furnishings and to the apartment, must be reported before departure and compensated in an appropriate manner (monetary compensation). The costs for the replacement of an equivalent replacement object are to be compensated. If an equivalent item cannot be procured, the costs for a replacement item in mint condition are to be reimbursed, whereby a replacement amounting to 80% is accepted. Unreported damages will be charged to the guest. The guest assumes liability for children and animals whose stay in the property without the written consent of the landlord is not permitted anyway and results in termination without notice by the landlord.
4. arrival and departure
The apartment is at the tenant's disposal from 15:00 on the day of arrival. It must be vacated by 10:00 a.m. on the day of departure. Different times are possible after arrangement, if the apartment is not occupied again on the same day. In case of need, we will be pleased to accommodate the tenant with alternative suggestions.
5. final cleaning
Final cleaning is included in the price. The basic cleaning is carried out by you as the customer, independent of the final cleaning by the landlord. The basic cleaning includes the cleaning of the kitchenette or the like, the rinsing and storage of the dishes, the removal of remaining food and all waste so that the rented property is handed over swept clean.
6. withdrawal by the tenant
Our flat-rate claim for cancellation fees is generally:
- 30 % of the total price from the 30th to the 15th day before the start of the booking,
- from the 14th to the 8th day before the start of the booking 50% of the total price,
- from the 7th day before the start of the booking 80 % of the total price.
7. cancellation by the landlord
The lessor is not liable for unforeseen circumstances (natural and other catastrophes - e.g. heat, snow masses, slippery roads, floods, hurricane-like storms - war, death of the owner of the house or his authorised representative, consequences of strikes or other forms of force majeure), which make the realisation of the rental agreement considerably more difficult or even impossible and can therefore withdraw from the rental agreement at any time. In this case, all sums already received less services already rendered will be refunded.
In addition, the Lessor may withdraw from the rental agreement or terminate it without notice if the Lessee culpably or negligently fails to fulfil his obligations under the rental agreement, especially in the event of any intentional or grossly negligent damage to the rental object or failure to meet due payments and payment deadlines.
8. number of persons
The rental object may only be used with the number of persons included in the booking request. The owner of the house or his authorised representative is entitled to expel any surplus persons from the rented property. The agreed price applies to the persons indicated in the booking request. If there is a higher number on arrival or during the stay, a surcharge of € 15 per night must be paid for each additional person.
After prior consultation, it may be possible to add additional beds.
9. pets and smoking
It is not permitted to bring pets with you. Smoking is forbidden in the whole house. Violation of this rule entitles the landlord to terminate the contract without notice. Smoking is permitted in the courtyard and the garage/lounge located there, as well as the loggia in Top 3.
10. liability
Compensation due to non-performance, delayed performance or defects can only be claimed if the lessor is responsible for them due to intent or gross negligence. The lessor does not assume any liability for personal belongings of the lessee, in particular valuables.
We generally recommend not to invite thieves to rob by openly presented or left objects. The photos reproduced on the web presentation are snapshots of the respective visit. Any changes to the furnishings (furniture, decoration) and equipment (electrical appliances, sanitary facilities) of the rental property are reserved and cannot be the subject of any claims by the tenant.
Any information not directly related to the rented property regarding its geographical location, tourist attractions in the immediate vicinity, etc., is intended solely to inform the tenant who is not familiar with the area in question without obligation. All size and distance data are therefore estimated values as accurately as possible without guarantee. All impairments resulting from non-compliance with the aforementioned provisions shall be borne by the tenant.
11. complaints
If at the beginning of the rental period or during the rental period defects are discovered in the rented property, the lessee is obliged to notify the lessor immediately. In accordance with applicable statutory provisions, the tenant is generally obliged to do everything reasonable to help remedy the defect. We do not participate in dispute resolution proceedings before a consumer arbitration board.
12. other provisions
A subletting of the rented object by the tenant is not permitted without the express permission of the landlord or his authorised representative.
Under no circumstances may motorhomes or caravans be set up on the property or the associated parking spaces; the prior permission of the house owner or his authorised representative must be obtained for the erection of tents on the property of the rental property.
13 Severability clause
The invalidity of individual provisions of the rental agreement or the General Rental Conditions shall not result in the invalidity of the entire rental agreement or the General Rental Conditions as a whole. Any discrepancies shall be eliminated in accordance with the remaining provisions. Verbal agreements between both parties shall only be legally effective if they have been expressly confirmed in writing by the Lessor or his authorised representative.
